These Terms of Service ("Terms") govern your access to and use of the FindSimilarStartups platform, operated by its owner ("we", "us", or "the Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Definitions

• "Service" refers to the FindSimilarStartups platform, including the website, APIs, AI-powered research tools, and all related features.
• "User" refers to any individual or entity that accesses or uses the Service.
• "AI Output" refers to any research, analysis, competitor information, or insights generated by the Service using artificial intelligence.
• "Credits" refers to the units used within the platform to generate new research and analysis.
• "Report" refers to a one-time AI-generated analysis purchased individually outside of a subscription.

2. Description of Service

FindSimilarStartups is an AI-powered startup research platform that generates insights, competitor analysis, and market research. The Service uses artificial intelligence, including third-party AI providers (Anthropic and OpenAI), to process user inputs and generate outputs.

• The Service provides AI-generated research and analysis. Accuracy, completeness, or timeliness of information is not guaranteed.
• AI outputs may contain errors, inaccuracies, or outdated information. The User must independently verify all information before making any decisions.
• The Service does not constitute professional advice of any kind, including but not limited to financial, legal, investment, or strategic advice.
• User inputs may be processed by third-party AI providers (Anthropic and OpenAI) to generate outputs. By using the Service, you acknowledge this processing.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You must provide accurate and complete information when creating your account.
• You must notify us immediately of any unauthorized use of your account.

4. Products and Pricing

The Service offers two types of offerings:

4.1 One-Time Report

• A one-time report is a single AI-generated analysis purchased individually.
• The report may serve as a base to create a startup profile within the platform.
• Users may upgrade from a one-time report to a full platform subscription at any time.

4.2 Platform Subscription

• The subscription grants access to the full platform and continuous research capabilities.
• Subscriptions are billed on a recurring basis and will automatically renew at the end of each billing cycle unless cancelled.
• You may cancel your subscription at any time through the Billing page. Cancellation takes effect at the end of the current billing cycle.

4.3 Credits

• Credits are used to generate new research and analysis within the platform.
• Subscription credits are refreshed at the beginning of each billing cycle. Unused subscription credits do not carry over and expire at the end of each billing period.
• Credit packages purchased separately are permanent and do not expire.
• When your credits reach zero, you may continue to access and read your existing reports and data, but you will not be able to run new research until credits are replenished.

5. Refund Policy

• Refunds may be issued if a report fails to generate, is defective, or if the platform experiences technical issues that prevent normal usage.
• If you are unsatisfied with the results of a report or service, you may contact our support team for review. We are committed to open communication and will evaluate each case individually.
• To request a refund, please submit a support ticket by emailing contact@findsimilarstartups.com. Include your account details and a description of the issue.
• Refunds are not guaranteed for unused credits or for change of mind. All refund requests are reviewed on a case-by-case basis by our team.
• For Users in the European Union: you may have additional rights under the Consumer Rights Directive, including a 14-day withdrawal period for digital purchases. These rights apply as required by applicable law.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal, fraudulent, or unauthorized purpose.
• Engage in spamming, abusive behavior, or any activity that disrupts the Service or its users.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Use automated scripts, bots, scrapers, or similar tools to access or interact with the Service.
• Exploit vulnerabilities or attempt to gain unauthorized access to the Service, its systems, or other users' accounts.

7. Use and Distribution of AI Outputs

• You may use AI Outputs generated through the Service for your own purposes.
• You may share or distribute AI-generated reports at your own discretion. In doing so, you assume full responsibility for any claims, damages, or liabilities arising from the use of such content by third parties.
• FindSimilarStartups makes no guarantees regarding the accuracy or suitability of AI Outputs for any specific purpose, and shall not be held liable for how shared content is used or interpreted by others.

8. Account Suspension and Termination

• We reserve the right to suspend or terminate your account at our discretion, without prior notice, if you violate these Terms or engage in behavior that may harm the Service or its users.
• Upon termination, your account data will be retained for a minimum of 30 days. After this period, your data may be permanently deleted.
• You may request deletion of your account and associated data at any time by contacting us.

9. Service Availability

• We strive to maintain continuous availability of the Service, but we do not guarantee uninterrupted or error-free access.
• The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• We reserve the right to modify, update, or discontinue features, pricing, or access at any time. Material changes will be communicated in advance when possible.

10. Limitation of Liability

• To the maximum extent permitted by applicable law, FindSimilarStartups shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• We are not responsible for financial losses, business decisions, or any actions taken based on AI-generated information provided by the Service.
• Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
• The User is solely responsible for how they use information obtained through the Service.
• Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intentional misconduct or gross negligence.

11. Intellectual Property

• The FindSimilarStartups platform, including its technology, design, branding, and underlying systems, is the exclusive property of its owner.
• Users are granted a limited, non-exclusive, non-transferable license to use the Service and its outputs for their own purposes. This does not constitute ownership of any intellectual property.
• By submitting content to the Service (such as startup descriptions or business information), you grant us a limited license to process your content solely for the purpose of providing the Service to you.

12. Privacy and Data

• Your use of the Service is also governed by our Privacy Policy, which describes what data we collect, how we use it, and your rights regarding your personal information.
• The Service uses third-party AI providers, including Anthropic and OpenAI, to process inputs and generate research outputs. By using the Service, you acknowledge that your inputs may be processed by these providers in accordance with their respective policies.
• We do not use your startup information to train public AI models or share it with third parties for their own purposes.

13. Changes to These Terms

• We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices.
• For material changes, we will notify you via email at least 30 days before the changes take effect.
• Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

14. Governing Law and Jurisdiction

• These Terms are governed by the laws of the jurisdiction where the operator resides, unless overridden by mandatory local consumer protection laws.
• For Users in the European Union, the mandatory consumer protection laws of your country of residence shall apply to the extent they provide greater protection than the laws of the operator's jurisdiction.
• In the event of a dispute, both parties agree to first attempt resolution through informal communication for a period of 30 days before pursuing any legal action.
• The English version of these Terms shall prevail in case of any discrepancy with translations.
